Formally a partner in White & Case's Intellectual Property Group, Mr. Gahtan's experience as a litigator goes beyond traditional IP disciplines.
His primary work has been on major pharmaceutical and life sciences patent litigation and appeals. In this area, he has represented clients such as Pfizer, UCB, Geneva, and Syngenta, for all of which he has succeeded at trial in various United States District Courts. Mr. Gahtan has also won appeals at the United States Court of Appeals for the Federal Circuit for many of the same clients. In an important recent Federal Circuit matter, Mr. Gahtan argued for and won (unanimously) one of the very few post-Therasense inequitable conduct affirmances, as a result of which his client was awarded all of its attorneys' fees through trial and appeal. Mr. Gahtan has also litigated patent cases in the semiconductor design, wireless communication, and internet application industries.
Mr. Gahtan is involved in the Firm's pharmaceutical antitrust litigation work, and he has litigated non-IP commercial matters for pharmaceutical companies and for companies in fields as diverse as industrial axial fans, large-scale entertainment venue engineering and construction, and aircraft leasing.
Mr. Gahtan has also litigated, through trial, trademark and false advertising cases, again often also in the pharmaceutical industry, and copyright cases in the music licensing, jewelry design, and sports team logo design industries. Mr. Gahtan has advised authors in the negotiation of film and television production agreements, merchandising agreements, and traditional and new-technology publishing agreements. He has also negotiated patent license agreements with major universities on behalf of biotech companies.
