Overview

As head of the Paris EU Antitrust and Regulatory Practice at White & Case, Jean-Paul Tran Thiet offers clients shrewd insight into EU and French Competition law. His hands-on experience spans regulated industries such as telecommunications, energy, pharmaceuticals and transport.

EU and France-based businesses seek Jean-Paul's guidance in competition-related and/or regulatory matters, such as cartels and concerted practices, dominant positions, mergers and state aids.

Companies may find themselves subject to dawn raids, or required to provide information or complete questionnaires for regulatory bodies. They may receive statements of objections or seek to challenge decisions against them. Alternatively, they may seek to raise their own objections about the anti-competitive practices of fellow companies.
With rigorous attention to both strategic vision and detail, Jean-Paul helps clients to better understand and manage their competition-related proceedings before the French Competition Authority, the EU Commission, as well as national and EU courts.

Jean-Paul supports clients with merger control notifications and state aid. He negotiates and drafts contracts on clients' behalf and helps with setting up national and international co-operation and distribution networks. Clients also benefit from his advice in adopting and complying with European and national laws, notably changes resulting from the liberalization of markets such as electricity and gas, telecommunications and broadcasting, transport (air, rail, sea, and urban transportation), pharmaceuticals and postal services. He represents clients in these areas before regulatory authorities, both at the national and EU level.

Before entering legal practice in 1992, Jean-Paul held top-ranking positions in Paris and Brussels, as special adviser to the Vice-President of the European Commission, to several French Ministers and to the French Prime Minister.

Since 1992, Jean-Paul has authored articles on EU law, competition and other legal matters in various journals, including: Les Echos, L'Entreprise, La Lettre des Juristes d'Affaires, Droit et Patrimoine, Le Revenu, Jurisclasseur, La Lettre d'Avenir Transport, AMIP Info, etc.
He remains a columnist for "Regulatory Affairs" in Concurrences, a French periodical published since 2004.

Experience

Leading global financial institution based in France

Jean-Paul Tran Thiet advised a leading French bank in the course of investigations by the European Commission and other antitrust authorities (Swiss Commission of competition, the US DoJ, etc.) relating to the setting of LIBOR and EURIBOR, including assisting the client during a dawn raid by the European Commission.

Coffee maker and coffee machine distributor

Jean-Paul successfully represented a coffee maker and coffee machine distributor in negotiated procedures before the French Competition Authority (FCA) on the competition law aspects of litigation that has sprung up in several European countries.

Global pharma giant

Jean-Paul represented a global pharma giant in relation to the full range of competition and regulatory concerns across France, including both prevention and compliance issues relating to EU regulation of the healthcare and life sciences sector.

Power cable producer

Jean-Paul represented a producer of power cables in proceedings before the European Commission, as well as before the European General Court, where he challenged the Commission's power to take copies of company computers and to interview employees during a dawn raid.

Car manufacturer

Jean-Paul successfully assisted a European car manufacturer accused of distorting competition by the French Government and the EU Commission in refusing to comply with EU Environment rules.

Multinational telecommunications company

Jean-Paul successfully represented a multinational telecommunications company in a procedure relating to unfair pricing as well as telecom infrastructure in overseas regions.
