Overview

Katarzyna Czwartosz-Liber advises clients from the real estate sector.

She has advised on a number of transactions, which mainly included real estate acquisitions, development, commercialization, as well as construction of buildings, such as shopping malls, supermarkets, exhibition centers, offices and residential buildings (including financing).

She has broad experience in advising developers and owners/managers of office buildings, warehouses and retail parks. She has carried out numerous legal due diligences of real estate. She prepares and negotiates contracts, and represents clients in administrative proceedings related to obtaining the relevant administrative decisions. She also represents clients in litigation and arbitration proceedings.

She participates in the preparation of investment structuring and their tax optimization, and in restructuring related to the sale of real properties.

Experience

CTP: representation of the CTP Group in the acquisition of a real estate portfolio from 7R, a Polish industrial developer, with potential to develop 1.2 million sqm of GLA in logistics and industrial real estate. The portfolio consists of projects in Silesia and central and northern Poland that are in the development phase, such as in Warsaw and Katowice, as well as other sites across Poland that are still in the pre-development phase.

REICO: representation of a fund managed by the REICO investment company, on the acquisition of BWI Group's R&D centre in Cracow, Poland from 7R, a polish developer and Insite Real Estate, a US investment company. The total lettable area of the buildings is approx. 11,000 sqm. The BWI's clients include brands such as BMW, Ford, Porsche, Audi, Ferrari, and Land Rover.

A value-add investment fund: representation of a value-add investment fund on the acquisition of logistics centers in Poland with a total value of approximately €40 million.

GS Engineering & Construction Poland sp. z o.o.: representation of GS Engineering & Construction Poland sp. z o.o. in connection with a joint venture development project of a warehouse property in Lower Silesia. The project, with an area of 200,000 sqm, which is being constructed close to some of the largest warehouses and factories of companies operating in the e-commerce and electric vehicle sectors in Europe, is to comprise five buildings intended to serve both warehousing and light industrial purposes, while around 14,000 sqm is to be office space.

M7: representation of M7 Real Estate, a European investor and asset manager, in connection with the acquisition of eight commercial properties in Poland in separate transactions for a total amount of €110 million. The most recently acquired assets are Cristal Park and Mokotów Plaza in Warsaw, as well as the office and warehouse properties Eurologis I, Eurologis II and Długosza BC in Wrocław. At the beginning of 2019, M7 also acquired Green Park, a modern business complex in Katowice, Delta 44, a high quality multi-let office building in Wrocław's city center and Mazovia Plaza, a seven-story office building in Warsaw.

Promontoria Hampton (1) Limited: representation of Promontoria Hampton (1) Limited (as a lender), being the subsidiary company of Cerberus Capital Management, L.P., and Balmain Polish Retail Investments sp. z o.o. (as a borrower) in connection with the sale by the borrower of portfolio of commercial real properties located in 8 different cities in Poland.

FLE: representation of FLE in connection with the acquisition of the Wratislavia Center mixed-use building located in Wroclaw.

International asset management company: representation of an international asset management company in connection with approx. €73 million forward purchase of an office building being developed by Skanska in Poznań, Poland. The building constitutes phase I of the New Market mixed-use complex.

Generali Real Estate: representation of Generali Real Estate in connection with the acquisition of the prestigious 8-story Piękna 2.0 office building in downtown Warsaw, offering approx. 15,800 sqm of first-class office space and commercial premises on the ground floor. For years, the law firm White & Case has had the pleasure of advising Generali Real Estate on the purchase of real estate in various countries and investments in the most modern, high-quality offices and commercial buildings.

Allianz Real Estate GmbH: representation of Allianz Real Estate GmbH in connection with the acquisition of a complex of office buildings in the Platinum Business Park located in Warsaw from Globe Trade Centre. Value of the transaction exceeded €173 million.
