Ex-Clerks and Experts Left Puzzled by Vague Report on 'Dobbs' Leak

On January 20, the Supreme Court issued its investigation report and findings concerning the Dobbs opinion leak and, as the report was breaking, The National Law Journal interviewed prominent expert practitioners and former clerks for their take on the report's findings. They spoke to White & Case partner Tara Lee, and she noted that what stood out from the report is what it didn't say.

"The report stops short of analyzing whether laws were broken," said Lee.

Lee also observed that the report fails to reach an explicit conclusion about whether an opinion leak is a violation of federal unauthorized disclosure laws.
