Biography
Ashley is an associate in the Firm's Financial Restructuring and Insolvency group. A bankruptcy litigator, Ashley represents clients in large chapter 11 cases in a variety of industries, including healthcare, infrastructure, energy, telecom, aerospace, pharmaceuticals, and financial services. Ashley has represented an array of parties in these proceedings, including debtors, secured and unsecured creditors, creditors' committees, and litigation trustees.
Clients benefit from Ashley's experience litigating various disputes in federal and state courts, as well as through alternative dispute resolution. Ashley's knowledge, skills, and attention to detail aid in developing and executing effective litigation strategies, especially with regard to accelerated trial proceedings in bankruptcy courts.
Additionally, Ashley has achieved successful results in pro bono matters, including civil claims related to animal law and a wrongful conviction.
Experience
Counsel to unsecured creditors' committee of healthcare transportation provider during chapter 11 proceedings contesting asset valuation and derivative standing;
Counsel to joint liquidators of a digital asset business in chapter 11 adversary proceeding against affiliated cryptocurrency exchange and trading firm;
Represented unsecured creditors' committee of genetics testing company during chapter 11 proceedings in its pursuit of derivative standing and contesting confirmation of the debtors' plan of reorganization;
Represented Brazilian entities in contested chapter 15 recognition hearing;
Represented the Settlement Trustee of and on behalf of the Samson Settlement Trust in connection with various fraudulent transfer claims; and
Member of a trial team that successfully represented a group of minority secured lenders in a post-chapter 11 arbitration proceeding, securing a damages award of nearly US$50 million against the majority lender for breach of the implied covenant of good faith and fair dealing in connection with the disposition of collateral upon the borrower's default.
