Overview

Ashley is an associate in the Firm's Commercial Litigation group. Her practice focuses on complex commercial disputes and bankruptcy litigation. She primarily represents clients in large chapter 11 cases in a variety of industries, including retail, energy, telecom, aerospace, pharmaceuticals, and financial services. Ashley has represented an array of parties in these proceedings, including debtors, secured and unsecured creditors, creditors' committees, and litigation trustees.

Clients benefit from Ashley's experience litigating various disputes in federal and state courts, as well as arbitration proceedings. A member of several trial teams, Ashley's knowledge, skills, and attention to detail aid in developing effective litigation strategies, especially with regard to accelerated trial proceedings in bankruptcy courts.

Additionally, Ashley has achieved successful results in pro bono matters, including civil claims related to animal law and a wrongful conviction.

Experience

Representative matters:

Member of a trial team that successfully represented a group of minority secured lenders in a post-chapter 11 arbitration proceeding, securing a damages award of nearly US$50 million against the majority lender for breach of the implied covenant of good faith and fair dealing in connection with the disposition of collateral upon the borrower's default;

Represented a large global investment bank in one of the last remaining cases relating to the Enron bankruptcy, in which plaintiffs alleged claims of aiding and abetting fraud, conspiracy, and underwriter liability;

Special litigation counsel to the indenture trustees for senior unsecured notes in the chapter 11 cases of Windstream Holdings, Inc.;

Represented the Settlement Trustee of and on behalf of the Samson Settlement Trust in connection with various fraudulent transfer claims;

Represented an unsecured notes indenture trustee and official committee member in the Nine West bankruptcy;

Represented a significant creditor in the Claire's Stores, Inc. chapter 11 cases.
