Intercos America, Inc.

Ongoing representation of a leading manufacturer of cosmetics products in defense of water contamination claims related to PFAS in the Southern District of New York.

Gerber Products Company

We serve as national counsel for Gerber, a defendant in an MDL and several state courts, including a Judicial Council Coordinated Proceeding, California's state court equivalent of an MDL, pending in Los Angeles County Superior Court, consolidating all California product liability cases in which plaintiffs allege neurological harm in the form of autism and ADHD caused by defendants' baby food products. In the two initial bellwether product liability cases, the court granted defendants' motions to exclude certain of plaintiffs' experts, granted defendants' motions for summary judgment and thereafter entered judgment in favor of defendants.

In the MDL, consolidating more than 450 cases in which plaintiffs alleged they suffered neurological harm in the form of autism and ADHD caused by defendants' baby food products, defendants also won motions to exclude plaintiffs' experts. Thus far, we have prevailed in all cases by winning motions to exclude plaintiffs' experts.

3M

Ongoing representation of 3M Company in connection with the Combat Arms Earplug multi-district litigation pending in the Northern District of Florida, the largest MDL in US history. Partner Mike Andolina was recognized by the MDL court as an "MDL MVP" for his role in negotiating a settlement structure to resolve more than 250,000 claims against 3M relating to alleged hearing loss. We continue to be involved in the administration of the settlement, which has yielded an unprecedented 99.99 percent participation rate.

Boy Scouts of America

Ongoing representation, as lead litigation and restructuring counsel to Boy Scouts of America (BSA), in connection with pre-bankruptcy litigation, and coordination of thousands of state and federal court personal injury claims, culminating in the negotiation, design and confirmation of BSA's chapter 11 plan. The BSA plan monetized the insurance rights of thousands of parties and established a settlement fund valued at more than US$2.4 billion, plus insurance rights estimated by the Bankruptcy Court to be worth at least an additional US$4.2 billion. White & Case successfully led the appeal proceedings on behalf of BSA in the US District Court for the District of Delaware, the US Court of Appeals for the Third Circuit and the US Supreme Court.

Honda

Represented Honda Motor Co. and its US subsidiary American Honda in connection with the largest global vehicle recalls in history arising from the Takata airbag recalls. The recalls led to the US and foreign bankruptcy proceedings, and massive multidistrict litigation in the US District Court for the Southern District of Florida In re Takata Airbag Products Liability Litigation, and numerous State AG investigations and lawsuits. White & Case designed an unprecedented resolution that channeled all current and future Takata-related claims against Honda to a settlement trust, effectively ending all litigation involving airbag ruptures. We continue to be involved in the administration of the trust on behalf of Honda.

Global biotechnology company

Representing the client in 1,000+ state court proceedings in Germany related to product liability claims and claims for information. The legal proceedings were initiated by individual plaintiffs in more than 100 different courts across Germany. As several of the plaintiff law firms are handling hundreds of cases, the defense in these proceedings across three court instances requires a coordinated approach and strategy.
