Bloomberg Law | NIL in college athletics adds layer of complexity to Title IX

White & Case partner Markus Funk published an article in Bloomberg Law examining how NIL compensation and House v. NCAA revenue sharing have created new Title IX risks for universities.

In the article, Funk urges schools to view every NIL-related resource, revenue-sharing formula and recruiting message about NIL support as a Title IX decision. He explains that institutions that "recognize and document this reality now will be in a far stronger position than those that don't when the legal reckoning arrives."
