DOJ chemical seizure shows broad civil forfeiture authority

White & Case partners Brent Wible and David Lim published an article for Law360 Expert Analysis on the US Department of Justice's September 3 announcement that it made the largest seizure by US law enforcement of precursor chemicals used to produce methamphetamine.

The authors explain that the DOJ used "the broadest forfeiture authority available to prosecutors" to seize the chemicals, which the DOJ stated had been shipped from China and were intended for clandestine labs in Mexico.

In the article, the authors examine the DOJ's prioritization of law enforcement actions targeting cartels and transnational criminal organizations, predicting that prosecutors will likely continue to "aggressively use broad terrorism forfeiture authorities triggered by the designation of Mexican drug cartels as foreign terrorist organizations to seize and forfeit cartel-related assets."
