Biography

Bethanie Abrahams is an associate in White & Case's Construction and Engineering group in Riyadh, specialising in front-end construction and project development matters, as well as the resolution of disputes arising out of complex energy and infrastructure projects.

Bethanie has experience across a range of sectors, having advised on the construction and financing of energy and power, data centre, infrastructure and energy transition projects (including green hydrogen and ammonia projects, battery energy storage systems, and wind farms). She has particular experience with FIDIC, JCT, NEC, and bespoke forms of contract, including EPC contracts, design and build contracts, supply agreements, technology licences, and consultant appointments.

In 2021, she spent six months on secondment to White & Case's Construction and Engineering group in Dubai.

Representative experience includes:

Representation of the Ministry of Energy of the Syrian Arab Republic and an international consortium led by Qatar-based Urbacon Concessions Investment, alongside Kalyon G.I.S. Energy, Cengiz Energy, and Power International (USA) on a US$7 billion project which entailed the development and operation of eight new power generation stations in Syria, with a total capacity of 5 GW. This landmark transaction represents a major step in Syria's efforts to rebuild its energy infrastructure and restore national power capacity after years of underinvestment and disruption.

Representation of Nala Renewables Limited on both the acquisition and project financing of a 50 MW ready-to-build Battery Energy Storage System (BESS) project in Kauhava, Finland in relation to the Balance of Plant, BESS supply and LTSA contracts.

Representation of senior financiers including Deutsche Bank, Asian Infrastructure Investment Bank, Black Sea Trade and Development Bank, Islamic Development Bank, Islamic Corporation for the Development of the Private Sector, ICBC, Silk Road Fund, Bank of Bahrain and Kuwait, Kuveyt Türk, Akbank, Garanti BBVA, QNB, VakıfBank, and Ziraat Bank, on the €1.7 billion senior secured financing for the Antalya-Alanya motorway project.

Representing the owner on the preparation of template and project-specific EPCM contracts for use on mining projects in Africa, as well as a FIDIC Yellow Book (1999) schedule of amendments for related works.

Representation of the lenders in respect of an African 350 MW hydroelectric generating project under development.

Representation of a global construction and project management company in respect of the preparation of template supply and licence agreements and EPC and LTSA term sheets for its international green hydrogen projects.

Representing the Employer in an arbitration arising out of the construction of an airport in the Middle East.

Representation of a leading global property developer in connection with the development of and construction of a data centre in the UK, including the negotiation of several bespoke consultant appointments, and NEC4 supply contracts and engineering and construction contract.

Representation of a specialist global industrial property and digital infrastructure group in connection with the development of a bespoke amended FIDIC Yellow Book (1999) for use on a number of data centre projects globally.  

Representation of a contracting and investment company Rönesans Holding on the financing of a €456 million public–private partnership (PPP) healthcare project for the construction and operation of a cutting-edge hospital in Kazakhstan, which is listed by the Government of the Republic of Kazakhstan as a project of particular significance.

Representation of a multinational energy corporation in relation to the development of a prospective oil and gas project in Namibia.

Representation of several lenders and developers in conducting due diligence reporting in respect of real estate purchases of property in the UK.

Representation of an asset manager in relation to the construction, operation and maintenance of EV charging infrastructure being developed at a portfolio of UK petrol stations.

Representing a Middle Eastern government in an arbitration concerning the construction of a new international airport in the country.

Representing the Employer in an ICC arbitration arising out of a contract for construction of a bridge in Africa. The contract was based on the FIDIC Red Book.

Representation of an international oil & gas company in a multi-billion USD arbitration relating to the construction of an LNG processing facility in the Asia-Pacific.
