Biography

Fadi Hajjar is an Associate in the International Arbitration Group of White & Case in Paris. His practice focuses on international commercial and investment arbitration. He has experience representing private corporations and public entities in both investment treaty and commercial arbitrations, as well as providing legal advice and guidance on ongoing projects and pre-dispute strategy.

Prior to joining White & Case, Fadi acquired experience in international arbitration in a major international law firm in Paris.

Fadi has also been actively involved in the Willem C. Vis International Commercial Arbitration Moot for a number of years.

Experience

Representing a Middle Eastern company in a London-seated LCIA arbitration under a joint venture agreement for an aluminium smelter project.

Representing a Portuguese telecoms company in an ICC arbitration in relation to damages awarded in another arbitration.

Representing the Kingdom of Saudi Arabia in PCCW Cascade (Middle East) Ltd. v. Kingdom of Saudi Arabia, an ICSID arbitration under the Saudi Arabia-China BIT relating to the claimant's interests in a telecommunications operator in the Kingdom of Saudi Arabia.

Representing Asian and European clients in an ICC dispute relating to a US$ 40 billion LNG project in Asia-Pacific.

Representing a Portuguese telecoms company in a multi-billion-dollar ICC arbitration arising out of a shareholder dispute concerning a telecoms company in sub-Saharan Africa and subsequent annulment proceedings.

Representing a Ministry from the Balkans in two ICC arbitrations relating to the construction of a hospital.

Representing a West African State entity in two ad hoc arbitrations regarding a concession to operate port infrastructure.

Representing a European industrial gas supplier in a mediation and an ad hoc arbitration relating to the effects of COVID-19 on the performance of a long-term gas supply agreement.

Representing a Middle Eastern telecoms group in an ICC arbitration arising from a shareholders' agreement in relation to its investment in Iraq.

Advising a Turkish contractor in relation to the pre-arbitral strategy of a construction project in the Gulf region.

Advising an African company in relation to a potential commercial arbitration arising out of breaches of a shareholders' agreement.

Advising a Saudi company in relation to its characterization as a State-owned entity or a governmental body and the applicable arbitration regime.

Advising the Saudi branch of a major hospitality group on the enforcement of foreign arbitration awards in the Kingdom.

Advising a major telecoms group in relation to potential investment treaty claims against a Middle Eastern State, arising out of a series of tax, regulatory and security-related measures.

Advising a Middle Eastern investor in relation to an ICSID arbitration against a Middle Eastern State.

Advising a Middle Eastern State organ on various issues of public international law, including matters related to the law of treaties and model bilateral investment treaties.
