Joshua is a senior lawyer within White & Case's Environment team. Joshua assists clients to navigate their most complex and pressing environmental and social risks.

In particular, Joshua regularly advises on:

  • the environmental, land tenure and approvals aspects of bespoke or cross-border transactions (including acquisitions, divestments, capital raisings and financings);
  • environmental, social and approvals issues arising from major projects (including advising on public hearing and appeal processes associated with project approvals, and integrating environmental, social and approvals issues into project documentation);
  • land access and assembly issues for major projects (including negotiating land tenure requirements for greenfield projects and advising on compulsory acquisition disputes); and
  • environmental compliance and regulatory issues (including contaminated land, licensing, pollution control, waste management and climate change).

Joshua has previous experience working as an environmental engineer at the world's leading sustainability advisory firm, and also as a corporate lawyer at a top-tier commercial law firm (specialising in the energy and resources sectors). This creates a strong platform from which he is able to deliver technically robust and commercially focussed outcomes.

Joshua advises both private sector and government clients, and focusses on the renewable energy, infrastructure and resources sectors. He has experience working across Australia, Asia, Africa, Europe and the Americas.

Transactional (Environment & Planning)

Wind and hydro asset portfolio sale*

Joshua advised a client on environmental and planning issues associated with its divestment of a portfolio of Australian wind and hydro assets. Joshua provided comprehensive vendor due diligence on a range of assets and also provided advice on managing identified risks within the transaction documentation.

Port of Melbourne Acquisition*
Joshua advised a bidder in relation to environment and planning risks associated with the acquisition of the port. In particular, Joshua worked closely with the environmental consultant to advise the client on historic contamination liability for past land uses and port dredging and dumping and the allocation of that liability in the transaction documents.

Residential property development*
Joshua advised a corporate buyer on all environmental, planning and heritage issues associated with their greenfields acquisition of an 8,000 lot residential sub-division in outer Melbourne.

Major project approvals / Land assembly (Environment & Planning)

Melbourne Metro Rail Tunnel Project*

Joshua advised the Melbourne Metro Rail Authority on all environment, planning, land access and acquisition matters. Joshua assisted the Authority to prepare the environmental effects statement and acted at the independent assessment committee hearing into the environmental effects of the project. Joshua is also advising on complex land access and acquisition strategies with respect to the project.

Regional Rail Project*
Joshua advised the Regional Rail Link Authority on the management and resolution of numerous complex compensation claims associated with the Regional Rail Link Project. Joshua engaged and consulted with experts to advise the client on all issues that may impact compensation from engineering, valuation, contamination, native vegetation offsets, planning land use issues and disturbance losses.

Planning appeal (mining)*
Joshua advised a mineral sands miner on its merits appeal to the Victorian Civil and Administrative Tribunal to secure necessary authorisations to facilitate the ongoing disposal of minerals sands by-products and support their continued operations in Victoria.

Wind energy projects*
Joshua advised Union Fenosa, Pacific Hydro and West Wind Energy with respect to their successful development applications for wind farm projects in Victoria, along with associated applications such as transmission lines and terminal stations.
