Biography

Overview

Marika Olczykowska is an associate in the White & Case Dispute Resolution and International Arbitration practice. She provides legal assistance to clients in court, arbitration and administrative proceedings. The cases she has advised on involve civil and commercial disputes, in particular regarding investment projects, including those implemented based on FIDIC contractual conditions, corporate matters and the performance of commercial contracts.

Prior to joining White & Case, Marika gained experience in the litigation and dispute resolution department of a leading Polish law firm based in Warsaw and through internships at other Polish law firms.

Marika represented the University of Warsaw in the Willem C. Vis International Commercial Arbitration Moot in 2020 and 2021 and was a member and speaker of the Polish team in the 6th Hugo Sinzheimer Moot Court Competition in 2022, in which the Polish team won 3rd place in the finals held in Lisbon, Portugal.

Her experience includes, inter alia:

A construction company: representation of a company in the construction sector in a case against the State Treasury of Poland for the payment of millions of PLN for a price adjustment under a construction contract based on FIDIC contractual conditions.

A confidential client: representation of the ordering party in a case against a contractor regarding millions of PLN in settlements of a contract for the construction of a wind farm.

An energy company: representation of an entity in the energy sector in a case involving violations by property owners who prevented the construction of a wind farm. Security of the claim was successfully obtained at the pre-litigation stage.

A producer of transport vehicles: representation of a European leader in the production of public transport vehicles in a case against a translation office for payment of compensation for improper translation of contractual documentation that led to damage to the client as the ordering party.

A state-owned company: representation of a state-owned company on assessing the risks and litigation options associated with legal proceedings pending in Polish courts for more than a decade prior to the sale of shares of the company.

Orkla ASA : representation of Orkla ASA on the Polish aspects of a transaction involving the acquisition of a strategic partner for Orkla Food Ingredients AS, a capital group operating in the production and distribution of a wide range of semi-finished food products.

A distribution company: representation of a major distributor in Europe in an arbitration case for the payment of several million PLN under a share purchase agreement.

An Italian company: representation of an Italian company in a court dispute with a Polish company related to a contract on the international sale of goods (the CISG), in which the court granted the client's claims in full.

A Polish company: representation of a Polish company in a case involving the execution of a preliminary agreement for the sale of shares in a limited liability company.
