Biography

Rachael Koc is an Associate in the Firm's Dispute Resolution practice based in Hong Kong.

Her practice focuses on international arbitration and commercial litigation, representing both local and global clients in complex, high-value disputes. She has experience with matters across a wide range of sectors, including financial services, construction and engineering, and technology.

Experience

Litigation

  • Acting for an investment company against a joinder and proprietary injunction application in a high-profile cryptocurrency dispute, successfully resisting the said application.
  • Acting for the joint and several liquidators of China Metal Recycling (Holdings) Limited (In Compulsory Liquidation).
  • Acting for a BVI company in obtaining a winding-up order in respect of a financial service provider for failure to satisfy a judgment debt pursuant to an arbitral award.
  • Advising a Hong Kong statutory body in opposing a judicial review application challenging a decision to refuse HKDSE applications made by an education centre on behalf of private candidates.
  • Acting for an American bank in the recovery of monies through spoofing-type fraud.
  • Advising a Hong Kong listed company in relation to potential regulatory breaches.
  • Advising a company in a claim against a former director for potential breaches of fiduciary duty and diversion of business.
  • Acting for the liquidators of a major construction company in Hong Kong in the recovery of assets.
  • Acting for construction companies in various applications in winding-up proceedings against a major Hong Kong construction company in liquidation.
  • Acting for a construction company in obtaining a winding-up order in respect of a property management company for failure to satisfy a judgment debt pursuant to an arbitral award.

Arbitration

  • Acting for a sub-contractor against a sub-sub-contractor in an arbitration in relation to the reclamation works for the Three Runway System Project in Hong Kong, involving a claim for approximately HK$300m, and a counterclaim for approximately HK$900m under the HKIAC 2014 Domestic Arbitration Rules. Proceedings involved an urgent ex-parte application for preliminary orders and interim measures to restrain the Shanghai-listed parent company of the sub-subcontractor from intimidating the client's potential witnesses, and an application for the determination of preliminary issues.
  • Acting for a statutory body in an arbitration defending against its main contractor's claims for delay and variation works under a main contract for infrastructure works under modified HKIAC 2014 Domestic Arbitration Rules. Proceedings involved an application for the determination of preliminary issues.
  • Acting for a construction company against a joint venture in an arbitration under modified HKIAC 2014 Domestic Arbitration Rules.
