Biography

Timothy is an associate in the firm's International Arbitration practice in Madrid.

Trained in both common law and civil law jurisdictions, his practice is focused primarily on international investment, commercial and construction disputes under leading arbitral rules, including the ICSID, UNCITRAL, ICC and CAM rules, in a variety of sectors. Timothy's experience also includes internal investigations in relation to bribery, corruption and related matters.

Before joining White & Case, Timothy gained experience in the White Collar Crime, Compliance and Internal Investigations department of a prominent Spanish law firm.

Experience

Some representative examples of Timothy's experience include assistance to:

  • A Japanese investor in post-award ICSID arbitration proceedings, including a defence against an annulment application.
  • A global energy technology company headquartered in Germany, the respondent in an ICC arbitration seated in Lima and governed by Peruvian law, concerning negligence claims related to the maintenance of a gas turbine at a power plant in Peru.
  • The contractors in a project for the construction of a water treatment plant in a delay dispute against the employer, under the laws of a Caribbean jurisdiction, in an ad hoc arbitration under the UNCITRAL rules.
  • Several investors in the renewable sector in different ICSID proceedings against a Central American state.
  • Successfully representing a Japanese investor in an ICSID arbitration against Spain under the Energy Charter Treaty involving investments in the Spanish CSP sector.
  • Successfully representing a Belgium industrial group as claimant in a post-M&A dispute against a Spanish fund, brought under a Share Purchase Agreement, in a Spanish law and English language arbitration before the Madrid Court of Arbitration.
  • Successfully representing an Eastern European State, in an ICSID arbitration initiated by a German investor under the Germany-Albania BIT, concerning a concession for the operation of a terminal in the Port of Durrës (case settled).
  • An ICSID award creditor on developing a comprehensive, multi-jurisdictional enforcement strategy against a European State.
  • A multinational group on a corporate restructuring to maximize the investment treaty protection of its worldwide assets.
  • A multinational technology corporation in internal investigations of potential bribery and corruption offences in Latin America.
