In response to a shifting geopolitical landscape and growing awareness that national security threats can become intertwined with economic competition, governments of advanced economies have expanded both the scope and reach of investment screening measures. This has created a variety of timing and substantive challenges for transactions. The shift from free flows of foreign investment to heightened government scrutiny has been rapid and significant. Today, the balance in overall regulation of investment has shifted toward active filtering of foreign investment flows. The new and expanded regulatory frameworks target countries that are perceived to present national security threats, and can also impact investors with relationships to those countries.
This seminar will feature FDI experts from White & Case, Karalyn Mildorf (a Washington DC office partner and a member of the Firm's FDI Reviews & National Security and CFIUS practice) and Orion Berg (a Paris office partner and a member of the Firm's FDI Reviews & National Security practice) who will discuss the latest global FDI trends and how best to assess and manage challenges that the new regulatory fences may create for Japanese investors in connection with their overseas.
