Biography

Bob Wagman is a Partner in White & Case's International Trade Practice and leads the firm's Government Contracts offering.

Drawing on more than two decades of experience, Bob serves as a trusted advisor to US and foreign companies of all sizes across a broad range of industries on all aspects of doing business with the federal government, including government contracts, grants and other federally funded projects. His multidisciplinary practice spans litigation before courts and administrative tribunals, complex transactional counseling and regulatory compliance matters involving US national security and the federal marketplace.

On the transactional side, Bob represents buyers, sellers and investors in corporate transactions involving government contractors, guiding clients through due diligence, deal structuring and the statutory and regulatory requirements governing transfers of government contracts. He has substantial experience with financing and restructuring transactions involving government contractors and has advised on transactions involving classified contracts as well as foreign acquisitions requiring foreign ownership, control, or influence (FOCI) mitigation procedures.

Bob's litigation and enforcement practice covers the full range of government contracts disputes and investigations. He represents clients in civil False Claims Act (FCA), qui tam, matters at all stages, from early-stage US Department of Justice (DOJ) and Inspector General investigations through trial, and has advised companies on voluntary self-disclosure obligations and conducted internal investigations on behalf of companies and boards of directors. He also represents clients in suspension and debarment proceedings, bid protest matters before the US Government Accountability Office (GAO), the US Court of Federal Claims (COFC) and contracting agencies and in prime/subcontractor disputes. Bob serves as a day-to-day counselor on government contract compliance matters, including intellectual property rights and corporate compliance program development.

Bob is the President of the Court of Federal Claims Bar Association. He joins White & Case from an international law firm, where he served as Head of the Government Contracts Practice.

Experience

Representative Matters:

Representing a provider of Public Key Infrastructure services to the government in litigation arising from a prime subcontractor dispute related to a US Department of State program.*

Representing a pipeline company in a suspension and debarment action before the Environmental Protection Agency (EPA) related to alleged Clean Water Act violations.*

Representing a national food services provider in a qui tam case alleging fraudulent billing at a major urban hospital.*

Successfully defending a publicly traded company in an eight-year grand jury investigation jointly conducted by the DOJ and the Department of Defense (DoD) Office of Inspector General into alleged bid rigging related to US Air Force contracts.*

Representing the sellers of a federal contractor in the sale of the company to private equity investors.*
