Kristian Cywicki

Kristian is counsel in the firm's Global Commercial Litigation Practice, based in Sydney.  He specialises in advising on the legal aspects of construction and engineering projects, and has experience in various forms of dispute resolution including arbitration, litigation, statutory adjudication and mediation. Kristian regularly advises clients (principals, contractors, sub-contractors, suppliers, professional consultants and developers) on complex, large-scale construction, infrastructure, energy, mining and real estate projects. 

A significant part of Kristian's practice is devoted to advising clients on contractual and commercial issues as they arise throughout a project's life cycle, and in relation to dispute avoidance and dispute resolution.

Representing Moorebank Intermodal Company in an arbitration relating to the $1.5 billion Moorebank Intermodal Terminal in south-west Sydney. Kristian is advising in relation to additional cost and delay claims arising from a development and operations contract.

Representing an international oil and gas exploration and production company in relation to a number of "rolling" statutory adjudications arising from an EPC contract for certain gas field development works. 

Advising (in a "project counsel" role) a leading infrastructure investment firm on a wide range of contractual and commercial issues relating to the construction and operation of a renewable energy project in Australia. 

Representing a UAE government-controlled entity in two DIAC arbitration proceedings against a private property developer in relation to the sale, purchase and development of plots of land in a reclaimed islands development in Dubai. *

Advising a well-known international contractor in relation to a claim for extension of time, and investigating the possible causes of delay, in connection with a high value renewable energy project in South-East Asia. *

Advising a China-based contractor in relation to prolongation costs and acceleration claims against a head contractor joint venture in connection with an airport project based in the UAE. *

Providing ongoing advice and strategic input to a construction joint venture in connection with its claims (amounting to AED 2.5 billion) and defending claims (amounting to AED 2 billion) arising in relation to a supertall tower in Dubai. *

Providing pre-litigation / arbitration advice and generally advising in connection with claims arising from contractor default, design defects, contract termination, variations, extensions of time, delay, disruption and prolongation claims, payment defaults and general breach of contract under a variety of standard form, and bespoke, contract conditions.
