Biography

Mauricio Mourglia is an International Law Clerk based in Miami and a member of the Firm's top-ranked International Arbitration Group. He has experience representing clients in international investment arbitrations under ICSID and UNCITRAL Rules, as well as in international commercial arbitrations administered by the ICC and other major arbitral institutions, with a particular focus on Latin America.

His experience spans a range of sectors, including oil and gas, mining, construction, aviation, telecommunications, renewable energy, agribusiness, maritime transportation, and port operations. Mauricio also regularly advises clients on complex civil matters across multiple jurisdictions, addressing regulatory, legislative, and policy issues, as well as on investment structuring and dispute prevention.

A national of Uruguay, Mauricio is bilingual in English and Spanish and is trained in both common law and civil law systems. He has lived and studied in Uruguay, the United Kingdom, and the United States.

Prior to joining White & Case, Mauricio was a Senior Associate at a leading Latin American law firm headquartered in Montevideo, where he handled international commercial arbitration, investment arbitration, and complex commercial litigation cases. He also served as an Adjunct Professor of Conflict of Laws at the Universidad de Montevideo. Since 2016, Mauricio has been involved as a participant, coach, or arbitrator in the Willem C. Vis International Commercial Arbitration Moot and related pre-moots.

Mauricio holds an LLB from the Universidad de Montevideo (Uruguay) and an LLM from New York University School of Law, where he was awarded the full-ride Hauser Global Scholarship. At NYU, he served as Graduate Editor of the NYU Journal of International Law and Politics.

Oil & Gas

Successfully represented an oil & gas major in an ICC arbitration relating to long term petroleum sales and supply contract (Mexican law, Houston seat). Settled on favourable terms for our client after strategic interim measures victory and other early procedural wins.

Successfully represented a multinational oil & gas major, Claimant in an ICC arbitration against a Bolivian state-owned company relating to the breach of a natural gas production agreement (Bolivian law, La Paz seat).*

Represented two leading natural gas distribution concessionaires, Claimants in two contract-based arbitrations against Uruguay under the ICC Rules (Uruguayan law, Buenos Aires seat) and the Rules of Arbitration of the Uruguay Chamber of Commerce (Uruguayan law, Montevideo seat). The disputes arose from the breach of the economic equilibrium of two concession contracts.*

Renewable Energy

Represents Guatemalan investors in an ICSID arbitration against the Republic of Honduras (ICSID Case No. ARB/23/43). The dispute arises from breaches of the CAFTA-DR and concerns Claimants' investments in a high-profile photovoltaic project. Ongoing.

Represents a Panamanian investor in an ICSID arbitration against the Republic of Honduras (ICSID Case No. ARB/23/40). The dispute arises from breaches of the Central America-Panama FTA and concerns Claimant's investment in a large-scale photovoltaic project. Ongoing.

Infrastructure

Successfully represented a Korean construction company, Claimant in an ICC arbitration against Uruguayan and Ecuadorean subcontractors (Uruguayan law, New York seat). The dispute involved the delay of the civil works of Uruguay's largest combined cycle power plant. The Claimant prevailed on the merits, after obtaining a favourable jurisdictional decision and overcoming provisional measures applications before Uruguay and New York courts.*

Successfully represented an Indian construction company, Claimant in a Uruguay Chamber of Commerce arbitration against the owner of a biomass plant related to erection and commissioning works (Uruguayan law, Montevideo seat). The dispute involved additional costs due to delays in civil works outside the Claimant's scope.*

Represented a leading Korean construction company, the Plaintiff in a lawsuit before Uruguayan Courts against a state-owned electricity company, referred to claims for extension of time and additional costs due to delays in the construction of a combined cycle power plant caused by force majeure. The case was settled.*

Represented a German contractor in an ICC dispute related to the construction of a major wind farm in Argentina (Argentine law, Buenos Aires seat). The case was settled.*

Represented a Belgian provider of drilling services in an ICC arbitration concerning a high-profile canal project in the Rio de la Plata (Uruguayan law, Montevideo seat). The case was settled.*

Telecommunications

Successfully represented investors in an investment arbitration against the Republic of Chile relating to the State's disruption of a landmark telecommunications project (ICSID Case No. ARB/24/30). The dispute centered on a 30-year concession granted to our clients for the installation and operation of an expansive, cutting-edge 5G wireless network across Chile, utilizing a significant portion of the national radio-electric spectrum. The case was settled.

Mining

Represented English investors in an UNCITRAL arbitration against the Oriental Republic of Uruguay (PCA Case No. 2018-04). The dispute arose from violations of the UK-Uruguay BIT due to the frustration of a major iron ore mining project.*

Aerospace

Successfully represented a leading Panamanian investor in an ICSID arbitration against the Oriental Republic of Uruguay (ICSID Case No. ARB/19/16). The dispute arose from violations of the Panama-Uruguay BIT due to the expropriation of a national flag airline.*

Other

Successfully represented a Uruguayan subsidiary of a port services company, Respondent in a Uruguay Chamber of Commerce arbitration against a Uruguayan company. The Claimant sought declaratory relief of the occurrence of force majeure justifying non-compliance with a transshipment agreement. The case was dismissed for lack of jurisdiction.*

Represented a Uruguayan subsidiary of a port services company in its application before the Uruguayan Supreme Court to recognize and enforce an award issued in New York against a Uruguayan company.*

Represented a leading U.S. hotel chain in an injunction before Uruguayan courts prior to an ICC arbitration to prevent the termination of a hotel administration contract and trademark license in Uruguay for alleged force majeure due to the Covid-19 pandemic.*
