Biography

Overview

Michał Subocz heads the Dispute Resolution and International Arbitration practice in the Warsaw office of White & Case. Michał focuses on dispute resolution before arbitration and common courts. His main area of practice is construction disputes. He has advised and represented major international and domestic construction companies in disputes related to their projects in Poland. The projects – mostly under FIDIC – concerned infrastructure, commercial centers, roads tunnels, stadiums, etc.

He is a member of the Arbitration Council of the Court of Arbitration at the Polish Chamber of Commerce, the Polish Arbitration Association, the Polish National Committee of the International Chamber of Commerce (ICC Poland), as well as an arbitrator in the Court of Arbitration at the Confederation "Lewiatan".

Prior to joining White & Case, he worked for a global law firm and at the Legal Department of the National Bank of Poland.

Last several editions of prestigious international reports Chambers Global, Chambers Europe and Legal 500 EMEA rank Michał in the Dispute Resolution category. Michał has been recognized by the latest edition of the Legal 500 EMEA ranking in the Construction category.

Advising contractors in disputes based on FIDIC contract terms as well as ongoing contractual advice preceding litigation and arbitration (including so-called claim management).

Advising a municipal company in a dispute with the general contractor of a transportation investment project before the Arbitration Court at the International Chamber of Commerce (ICC).

Representing an international construction company in a series of disputes with the investor before the Arbitration Court at the ICC.

Advising a Finnish energy company in arbitration proceedings related to a construction dispute.

Representation of a leading construction company in Poland in relation to a number of court proceedings, including claims for payment and injunction applications with regard to bank guarantees, against the GDDKiA (the General Directorate for National Roads and Motorways) and other investors.
