Biography

Talia Bally is an Associate in White & Case's International Arbitration group, based in Geneva. Her practice focuses on international arbitration and Swiss law advisory work. She has developed a broad knowledge of various industries, including energy, transportation and distribution.

Talia advises and represents clients in international arbitration proceedings under major arbitration rules, including in particular ICC arbitration. She has experience representing parties before Swiss courts, including the Swiss Federal Tribunal in annulment proceedings, and provides legal opinions on Swiss law, particularly Swiss contract law and intellectual property law. Her matters span a wide range of substantive issues, including trading disputes, M&A-related disputes, energy and infrastructure disputes, construction and engineering matters, and corporate disputes.

Experience

Member of the team representing an EPC contractor in a dispute against the project owner relating to the construction of a refinery in the EU (ICC arbitration). The dispute concerned delays and raised various issues, notably regarding the application of limitations of liability.

Member of the team representing an inspection and certification company in a dispute against a commodities trader arising out of a supervision contract. The dispute raised significant issues concerning the scope of the inspection obligations and the application of limitations of liability.

Member of the team representing a major industrial company in a multi-party ICC arbitration arising out of an industrial project, raising complex issues of contract interpretation and expert evidence.

Member of the team representing an energy company in an ICC arbitration against a major gas supplier, concerning the dismantling of the claimant's contractual rights and economic entitlement. The dispute raised issues of bad faith, state interference, and alleged misappropriation of assets.

Member of the team representing a subcontractor in an ICC arbitration arising out of works performed at an oil refinery, following termination of the subcontract. The dispute raised issues of delay, quality of works, and alleged mismanagement.

Member of the team representing a seller in an ICC arbitration arising out of a share purchase agreement for the sale of a global business active in the inspection, testing and certification sector. The dispute arose following termination of the transaction and raised issues of contractual termination rights.

Member of the team representing a National Anti-Doping Committee in a CAS Arbitration brought by the World Anti-Doping Agency stemming from alleged failure to address several requirements for its anti-doping program.
