Mexico Initiates Antidumping Investigation on Imports of Epoxidized Soybean Oil Originating from the Federative Republic of Brazil and the People's Republic of China

Today, the Ministry of Economy published in the Official Gazette of the Federation a resolution declaring the initiation of an antidumping investigation on imports of epoxidized soybean oil originating from the Federative Republic of Brazil and the People's Republic of China, irrespective of the country of exportation (see publication in Spanish only).
The product under investigation is epoxidized soybean oil, either in pure or concentrated form, not mixed with other substances and/or plasticizers, or in mixtures containing 85% to 99% epoxidized soybean oil mixed with other plasticizers.
The Ministry of Economy has established the investigation period as from April 1, 2023, to March 31, 2024, and the injury analysis period from April 1, 2021, to March 31, 2024.
The tariff classifications under which epoxidized soybean oil entered Mexico are 1518.00.02 and 3812.20.01, subject to tariffs of 15% and 5%, respectively.
The commercial names used by exporting companies and Mexican importers to identify the product under investigation include, but are not limited to, "Soyflex 63", "Epoxidized Soybean Oil Soyflex 6330", "Inbraflex A-6", "Soyflex A-6", "Inbraflex A6 Fg", "Drapex 6.8", "aceite de soya epoxidado", "aceite epoxidado de soya", "ESO" and "epoxidized soybean oil."
Interested importers, exporters, or domestic producers wishing to participate in the investigation will have 28 business days to submit their responses to the prescribed forms, as well as any arguments and evidence they deem relevant. The deadline for such submissions is October 22, 2024.
Finally, it is worth noting that imports of epoxidized soybean oil classified under tariff headings 1518.00.02 and 3812.20.01 are already subject to countervailing duties when originating from the United States and Argentina, respectively.
