White & Case partner Paul Brumpton and associate Sushruta Chandraker recently authored this article in Law360, highlighting two recent cases which demonstrate the caution that must be exercised when using AI in litigation. Whilst Ayinde v. London Borough of Haringey and Al-Haroun v. Qatar National Bank and QNB Capital are both litigation cases, lessons can also be applied to the increasing use of AI in international arbitration. As they note "optimism about the possible usages of AI needs to be tempered by caution about the risks of embedding the technology in such a subtle and sensitive area of law."
