Bloomberg Law | Closed AI platform delivers fast answers to lawyers during trial

Holly Zheng (White & Case LLP) and Timothy Fraser (Chief Legal Officer, Toshiba America) co-authored an article in Bloomberg Law, detailing how they designed what may be the first-reported custom AI platform used during a complex commercial trial. According to the authors, by using the platform, "senior attorneys could execute faster when their team could provide results at 8:00 p.m., instead of 8:00 a.m. the next day."
The authors discuss how they trained the AI platform to provide accurate outputs on technical subjects, and list examples of how the trial team used the platform during trial, including for rapid document retrieval, assessments of voluminous materials and preliminary answers to urgent questions from attorneys in the courtroom.
The authors also underscore the safeguards essential to responsible use of AI in litigation, including restricted access, confidentiality protections, privilege controls and rigorous human verification.
