
In an article for Corporate Counsel, White & Case partner Joel Cohen discussed the US Justice Department's recent reorganization, which ended the Consumer Protection Branch (CPB) and created a new civil enforcement branch.
Joel explained that these changes are part of a broad trend that predates the current administration, in which CPB attorneys have become involved in more criminal matters. He said, "What this indicates is a further solidification of the concept that what used to be viewed as primarily civil enforcement has moved into a realm where they consider it for criminal enforcement."
When asked whether the dispersal of the CPB's functions and expertise could bring about unique challenges, Joel noted that "in every area where sophisticated defense counsel operate," counsel can effectively educate prosecutors about industries with which they may not be highly familiar.
