Biography

Russell Gould is a partner in the Firm's Litigation Group. He represents clients in their most significant commercial disputes, including high-stakes litigation and arbitration.

Russell focuses on complex commercial litigation, consumer class actions, mass arbitrations, product liability, contract disputes, business torts, privacy, and unfair competition matters. He has a nationwide practice with extensive experience in federal and state courts, particularly in California, and has succeeded at every stage of litigation, from early dismissal to first-chairing and second-chairing jury trials, arbitrations, and appeals.

Russell represents clients across a broad range of industries, including banking and finance, consumer products, fitness, food and beverage, manufacturing, social media, and technology. He also advises clients on litigation risk and strategic business decisions to minimize exposure and position them favorably when disputes arise.

Russell serves on the Board of Governors of the Association of Business Trial Lawyers. He has been recognized as a Super Lawyers Rising Star and Best Lawyers: Ones to Watch for Southern California.

Russell honed his courtroom and trial skills while first-chairing criminal jury trials as a prosecutor in the Los Angeles County District Attorney's Office. During law school, he served as a judicial extern to the Honorable James Donato of the U.S. District Court for the Northern District of California and earned the American Jurisprudence Award in Evidence.

Consumer Class Actions, Mass Arbitrations, and Multidistrict Litigation

  • Representing multiple consumer-facing companies in connection with mass arbitrations.
  • Obtained complete dismissal of multidistrict litigation against Nestlé USA involving hundreds of personal-injury actions arising from alleged heavy metals in baby food.
  • Obtained dismissal of several putative consumer class actions in federal courts in California, Illinois, and New York against Nestlé USA and Gerber.
  • Secured dismissal of a putative consumer class action against an agricultural products manufacturer and distributor.
  • Secured reversal of a district court order remanding a putative antitrust class action against Purina to state court, leading to the district court's dismissal of the claims.
  • Defeated class certification in a putative class action against a technology company arising from a data breach.
  • Compelled arbitration of a consumer class action against Fitness International, LLC (LA Fitness) challenging alleged practices central to its operations, defeated repeated efforts to return the dispute to court and pursue class and representative claims, and prevailed on all claims following the arbitration hearing.
  • Compelled individual arbitration in multiple putative class and consumer actions, resulting in the withdrawal of claims or resolution through favorable nominal settlements.
  • Advised and developed strategies for multinational corporations to mitigate the risk of potential mass arbitrations, class actions, and claims based on consumer-protection and privacy laws.

Complex Commercial Litigation, Business Disputes, and Arbitrations

  • Obtained dismissal of fifteen actions against hedge fund defendants alleging claims under a federal trafficking statute based on hundreds of millions of dollars in financing.
  • Represented Walkers, an international law firm, and defeated RICO and fraud claims in an action filed by a prominent investor seeking over $100 million, obtaining complete dismissal for lack of personal jurisdiction and failure to state a claim.
  • Represented the Export-Import Bank of Korea as the plaintiff, defeated summary-judgment motions, secured the disqualification of an international law firm based on a conflict of interest, and favorably resolved the litigation arising from the country’s largest financial fraud scheme involving billions of dollars.
  • Represented Avast Software, a Czech multinational cybersecurity software company, in an arbitration involving a software-licensing dispute.
  • Represented Experian in an arbitration with T-Mobile arising out of a data breach.

Product Liability and Manufacturing Disputes

  • Obtained summary judgment for a subsidiary of IMA Group, a global processing and packaging manufacturing company, on claims by its customer seeking $140 million following the sale of automated packaging equipment for food products; currently representing the manufacturer in the plaintiff’s appeal of the judgment to the U.S. Court of Appeals for the Ninth Circuit.
  • Represented Nestlé USA in multiple product-liability and breach-of-contract actions in state and federal courts across the United States against suppliers following separate nationwide recalls resulting from a contaminated ingredient and a defective rubber hose, achieving favorable settlements.
  • Counseled Gerber on the launch of a new product in connection with product-liability laws in all fifty states.
