Metso-Outotec merger clearances

We successfully obtained global clearances for Metso Corp. in its €4 billion merger with Outotec Oyj in the mineral processing equipment industry, obtaining merger clearances in 19 worldwide jurisdictions in an expedited timeframe. The acquisition involved recombining two businesses the FTC broke up nearly 20 years ago. View the press release here.
Antitrust win in Usher case
We succeeded in obtaining dismissal of antitrust charges from the pending Office of the Comptroller of the Currency (OCC) proceeding against J.P. Morgan Forex trader Richard Usher. The Foreign Exchange cases were the largest set of antitrust fines in US history, and the largest set of bank fines in history. OCC dropped all antitrust charges after bringing its case in parallel with the DOJ. We defeated the DOJ case at trial in October 2018.
Antitrust action defeat
We defeated a collective antitrust action for Restaurant Brands International and its affiliate company Tim Hortons USA. After reading our motion to dismiss, the plaintiffs gave up their antitrust claims, unwilling even to argue against us—an event previously unheard of in the US.
Successful business review for hog farmers
We secured the first successful business review from the Department of Justice for a non-healthcare company under the US Department of Justice’s expedited COVID procedures. The favorable outcome on behalf of America’s hog farmers (National Pork Producers Council) assured a continued supply of protein to US households at a critical time during the pandemic.
Cartel surcharge order overturned

We advised Kato Kagaku on a price-fixing claim filed against Kato Kagaku by the Japan Fair Trade Commission (JFTC) as part of the JFTC’s investigation into an alleged cartel. This was the first and only case in which the JFTC overturned its surcharge payment order entirely.
