White & Case partners Joel Cohen and Ladan Stewart and law clerk Jasmine Chen published an article for Bloomberg Law analyzing the regulatory landscape around private credit.

The authors note that private credit's "continuing, rapid growth has brought heightened regulatory scrutiny," with managed assets expected to reach US$5 trillion by 2029. Within this context, the authors highlight several regulatory risks, including valuations, potential conflicts of interest and underwriting standards, and provide guidance for fund managers to strengthen their governance and compliance frameworks.
