
White & Case partner Ladan Stewart and associates Gabriella Klein and Shuhang Liu published an article for the New York Law Journal examining the SEC's recent dismissals of litigated cases and what insights they provide into the agency's enforcement approach under Chairman Paul Atkins.
The authors note that the SEC's decision to seek dismissal of litigated cases based on policy changes at the agency is "without recent precedent," and signals the new SEC administration's intention to focus enforcement resources on "cases involving allegations of fraud resulting in harm to investors," including "'bread and butter' enforcement cases, such as insider trading, offering frauds and accounting fraud, based on tried-and-true legal theories."
