Biography
Carla is an associate in the Global Commercial Litigation Practice based in Sydney.
Carla regularly advises on complex commercial and construction disputes, regulatory issues, and corporate investigations, including matters with a cross-border dimension.
Carla has experience in proceedings before the State Supreme Courts, the Federal Court of Australia and the High Court of Australia, as well as alternative dispute resolution processes.
Carla is a qualified Chartered Accountant and brings a unique blend of legal and financial knowledge to her practice. Before joining White & Case, Carla was a Chartered Accountant in Ernst & Young’s Financial Services division.
Experience
Relevant selected litigation experience includes:
- Republic of India: Acted for the Republic of India in successful proceedings before the Full Federal Court and High Court of Australia arising from a high-value foreign investment dispute. The matter raised novel issues concerning the enforcement of arbitral awards against foreign states and is regarded as a significant development in Australian public international law, with broader implications for the enforcement of arbitral awards internationally.
- Callide C Power Station: Acted for the administrators of the entities holding a 50% interest in the 800MW Callide Power Station following the catastrophic failure of two generating units. The engagement involved one of the largest public examination processes in Australian corporate history and the management of disputes concerning the operation, ownership, governance and sale of a strategically significant energy asset. The matter culminated in a successful exit from administration with returns to both creditors and shareholders.
- FTI Consulting as administrators: Acted for the Administrators in responding to notices to produce in the Federal Court of Australia as part of the external administration of companies within the IG Power Group.
- Kogas, Total, and PUPL as joint venture parties: Acted for the joint venture parties in an unincorporated joint venture for the production of coal seam gas in Queensland in Supreme Court of Queensland proceedings concerning the obligation to pay royalties and involving analysis of complex contractual provisions.
- Fosterville Gold Mine Pty Ltd: Acted for Fosterville Gold Mine Pty Ltd in common law nuisance proceedings in the Supreme Court of Victoria arising from the operations of the Fosterville Gold Mine in regional Victoria.
- West Gate Tunnel: Acted for Transurban in relation to disputes arising in connection with the A$6.7 billion West Gate Tunnel project.
- Security of Payment Adjudications: Acted for a head contractor in security of payment adjudication proceedings under the Building Industry Fairness (Security of Payment) Act 2017 (Qld).
Relevant selected regulatory experience includes:
- Regulatory advice: Advised on the application of sanctions and anti-money laundering and counter terrorism financing laws in respect of digital assets / non-fungible tokens.
- Financial services advice: Advised banks on the application of Australian financial services laws and regulations, including preparing and reviewing policies and procedures, and obligations registers which assist banks in monitoring compliance with their legal, regulatory, and internal requirements.*
- Conflicts of interest: Appointed to conduct an independent review of the conflicts management culture and approach to conflicts management for a vertically integrated financial services business and superannuation fund, including an assessment against APRA prudential standards.*
