Biography
Noor Davies is a partner in the International Arbitration Practice Group based in Paris. Her practice focuses on representing and advising investors, sovereign States and State entities in high-stakes international disputes involving complex issues of law and fact and spanning a wide range of industries, including power and energy, telecommunications and infrastructure.
Experience
Representing Nigeria in KNOC and others v. Federal Republic of Nigeria, an ICSID arbitration brought under the Nigeria-South Korea BIT in relation to an investment in the oil and gas sector;
Representing Georgia in parallel ICC and ICSID arbitration proceedings brought respectively by a local company and its Dutch indirect minority shareholder in connection with a dispute arising out of the termination of an investment agreement to build and operate a deep-sea port. Both arbitrations concluded with a dismissal of all claims;
Represented Iraq Telecom Ltd. in an ICC arbitration against Korek Telecom Company and Sirwan Barzani involving direct and derivative claims for fraud, corruption and other breaches of a shareholders' agreement governed by English law, which resulted in a US$ 1.65 billion award in favour of our client;
Representing Georgia in coordinated SCC and ICSID arbitration proceedings brought by a major Russian energy company and its Dutch and Georgian subsidiaries in relation to a dispute over the regulation of electricity tariffs;
Represented Georgia in an arbitration brought under the UNCITRAL Arbitration Rules pursuant to the 1996 Georgia-Kazakhstan BIT and the Energy Charter Treaty in relation to a dispute over the regulation of gas tariffs which resulted in a favourable settlement for Georgia;
Represented JSC BTA Bank in an UNCITRAL arbitration brought under the Kazakhstan-Kyrgyzstan BIT in relation to a dispute arising out of an investment in a Kyrgyz bank which was discontinued following a favourable settlement;
Represented the claimant in B3 Croatian Courier Cooperatif U.A v. Croatia, an ICSID arbitration under the Netherlands-Croatia BIT in relation to an investment in the postal sector;
Represented the claimants in ENGIE and others v. Hungary, an ICSID arbitration under the Energy Charter Treaty and the France-Hungary BIT relating to the regulation of gas tariffs which resulted in a favourable settlement for the investor;
Represented OTMTI in Orascom TMT Investments S.à r.l. v. People's Democratic Republic of Algeria, an ICSID arbitration arising under the Belgo-Luxembourg-Algeria BIT in relation to an investment in the telecommunications industry;
Successfully represented Flemingo DutyFree in an UNICTRAL arbitration brought against Poland under the Poland-India BIT in relation to an investment in the duty free sector;
Successfully represented the Republic of Uzbekistan in Oxus Gold PLC v. Republic of Uzbekistan, an UNCITRAL arbitration under the UK-Uzbekistan BIT arising out of a dispute concerning mines containing gold, silver, and other metals in which the tribunal dismissed 99% of the claimant's US$ 1.3 billion claim;
Successfully represented Hungary in Vigotop Ltd. v. Hungary, an ICSID arbitration arising under the Hungary-Cyprus BIT in relation to the alleged cancellation of a project to build and develop a mega casino resort; and
Successfully represented Ukraine in Bosh International Inc. and B&P Foreign Investments Enterprise v. Ukraine, an ICSID arbitration arising under the Ukraine-United States BIT in relation to the development and operation of a hotel and science complex.
