Biography
Claire is a Senior Associate in the Intellectual Property team at White & Case based in Sydney.
Claire has expertise in technology-based projects and complex commercial contracting and in advising clients on data protection and cyber security related matters, including on compliance with the Privacy Act 1988 (Cth) and other regulatory requirements. Claire regularly advises clients on the management of cyber incidents - providing advice on the notifiable data breach regime in Australia and assisting with notifications to regulators and impacted individuals.
Claire has undertaken several secondments with clients supporting their in-house technology and procurement teams.
Experience
Advising domestic and international clients in a number of sectors (including retail, banking, technology and insurance) in relation to compliance with the Privacy Act 1988 (Cth) and state and territory privacy laws including assisting clients in undertaking data governance projects, privacy impact assessments, data mapping and privacy compliance uplifts. These comprehensive projects include reviewing the data handling policies and procedures and advising on steps to ensure compliance with Australian privacy laws and include cyber incident preparation as well as data retention and destruction programs.*
Advising clients on data breach and cyber incidents, including on the application of the mandatory data breach notification regime, communications with regulators and notifications to impacted individuals and on issues relating to contractual arrangements with customers / service providers, both domestically and on larger incidents involving multiple jurisdictions.*
Advising and assisting a large insurance group on a major outsourcing project including development and documentation of commercial arrangements.*
Assisting on the IP, technology, data protection and privacy aspects of corporate transactions including acquisitions, sales and IPOs involving software developers and technology companies.*
