
White & Case partner Joel Cohen spoke with WIRED about the Department of Justice's (DOJ) decision to move forward with the Tornado Cash trial.
The article explains that Roman Storm, a developer of the software tool Tornado Cash used for anonymizing cryptocurrency holdings, is set to stand trial on July 14, facing charges including conspiracy to commit money laundering and sanctions violations, and conspiracy to operate an unlicensed money transmitting business.
While Deputy Attorney General Todd Blanche previously announced that the DOJ would deprioritize certain crypto prosecutions, Joel noted that the DOJ's decision to press onward with this case "might be interpreted as a signal of its confidence in its evidence—the full scope of which will only become clear at trial—and extent of the wrongdoing."
"When prosecutors get down to the issue of proving a case, they're not thinking about how the case aligns with the department's philosophy," Joel added. "When you get into battle, you fight like heck. That's what you do."
