Biography

Ruta Skučas is a partner in White & Case’s Global Project Development and Finance Practice and Global Energy Industry Group, based in Washington, DC. With more than two decades of experience engaging with the Federal Energy Regulatory Commission (FERC), Ruta advises clients across the electric power and natural gas sectors on navigating complex and evolving federal and state regulatory regimes.

Ruta is a leading federal energy regulatory and wholesale electricity markets attorney, with extensive experience before FERC, independent system operators, and regional transmission organizations (ISO/RTOs). She brings a deep understanding of wholesale electricity markets and energy trading, and is a trusted advisor to power companies, energy traders, renewable developers, and independent transmission developers on compliance, enforcement, and strategic regulatory matters.

Clients rely on Ruta to represent them in proceedings before FERC and to counsel them on a broad range of issues faced by market participants, including market design, stakeholder engagement, and the development and implementation of strategies to effect changes in market rules. She regularly advises renewable generation and independent transmission developers on strategic regulatory considerations and requirements, as well as project development matters, including interconnection, reactive power compensation, capacity market participation, financings, and mergers and acquisitions involving renewable and natural gas-fired generation.

Ruta also advises clients on energy policy matters, including engagement with FERC and the US Department of Energy on rulemakings and policy initiatives. Her practice is informed by a sophisticated understanding of how regulatory policy, market rules, and commercial realities intersect.

Ruta has significant experience assisting clients in non-public investigations conducted by the FERC Office of Enforcement. She conducts internal investigations to assess potential compliance issues, advises on remediation strategies, and prepares self-reports to FERC where appropriate. She has represented energy traders and renewable asset owners in enforcement matters involving depositions and data requests, guiding clients through all stages of investigative and enforcement proceedings.

Before joining White & Case, Ruta served as a partner at a full-service law firm, where she focused her practice on energy regulation, reliability, project development, and energy trading. Following law school, she served as a law clerk to several FERC Administrative Law Judges, supporting administrative litigation and settlements. After eight years in private practice, Ruta returned to FERC, where she served in the Office of General Counsel, drafting orders related to PJM, MISO, electric reliability, and natural gas.

Ruta also served as legal advisor to former FERC Commissioner Cheryl LaFleur, where she played a key role in shaping electric and natural gas policy, with a particular focus on PJM, MISO, and transmission planning and cost allocation, including under Order No. 1000.

Experience

Assisted a developer of a utility-scale solar and battery storage facility in Arizona in negotiating property rights.*

Advised battery storage facility on CAISO tariff and market rules as part of FERC Enforcement investigation.*

Advocated on behalf of an independent power marketing group in stakeholder proceedings before both the Southwest Power Pool and ERCOT regarding potential credit changes resulting from extreme weather events, specifically Winter Storm Uri in Texas.*

Advised a hedge fund manager focused on investments in electricity markets regarding non-adverse energy regulatory and compliance matters.*

Represented merchant transmission developer in developing and implementing PJM stakeholder strategy for proposed rule change.*

Prepared and filed a complaint to FERC regarding efforts by a renewable energy transmission project to connect to the grid managed by PJM Interconnection, LLC.*

Prepared and filed a complaint to FERC regarding the inability of resources connected via HVDC transmission to participate in PJM capacity markets.*

Filed a complaint with FERC on behalf of an energy trading company participating in the ISO/RTO markets regarding the PJM FTR Forfeiture Rule applicable to virtual transactions and FTRs.*

Advised power marketing entity in non-public self-report to FERC's Office of Enforcement regarding physical power sales transactions in ISO/RTO markets without market-based rate authority.*

Prepared and filed reactive power application on behalf of newly developed natural gas filed generation facility; negotiated settled outcome with FERC Trial Staff.*

Presented annual federal regulatory compliance training.*

Prepared market-based rate application for energy trading firm.*

Represented LDC in natural gas rate case before FERC by Texas Eastern Transmission Co.*

Prepared and filed application for electricity export permit with US Department of Energy for authorization to export electricity to Canada and Mexico. *

Advised energy trading company on regulatory requirements and compliance in creation of asset management function.*
