Global law firm White & Case LLP has advised Wabash Valley Resources, LLC, on the US$1.5 billion Department of Energy (DOE) Loan Programs Office financing in support of an ammonia fertilizer facility in Indiana.

The loan will help finance a clean ammonia fertilizer facility in West Terre Haute, Indiana. The project will restart and repurpose a coal gasification plant idled since 2016 to produce 500,000 metric tons of anhydrous ammonia per year.

"This project showcases our ability to advise on first-of-its-kind projects," said White & Case partner Peter Berg, who led the Firm's deal team. "It also sets the benchmark for major blue ammonia, clean fertilizer, and carbon capture and sequestration projects, globally."

The project will strengthen domestic supply chains, lower costs for farmers and consumers, and strengthen national food security for the United States by producing cost-competitive ammonia for the Eastern Corn Belt while creating hundreds of jobs. The Wabash financial close is the second closed loan under the Energy Dominance Financing (EDF) Program created by the Working Families Tax Cut, also known as the One Big Beautiful Bill Act.

The White & Case team was led by Project Development and Finance partner Peter Berg (Houston), and included Project Development and Finance partners Nandan Nelivigi (New York) and Suzanne Perry (Washington, DC), counsel Alfred Wang and associates Gabrielle Goodrow, Jessica Webb, Colleen Anderson, Hsin-Yi Pan, Adam Conwell, Tunmise Omotoyinbo (all in New York) and Emily Pendleton (Houston); Tax partners Jeffrey Davis and Michael Sykes and associate Jordan Jentz (all in Washington, DC); and Government Contracts partner Melissa Taylormoore (Washington, DC). Law clerk Sebastian Cross (New York) also assisted on the matter.
