Sharp Split Arising over Competing Data Breach Bills

Following many security data breaches occurring across the country, two pieces of legislation are gaining national attention. The Senate’s Consumer Privacy Protection Act of 2015 would require companies to inform consumers within 30 days of a breach. The House’s Data Security and Breach Notification Act would give companies the opportunity to decide if a breach would financially harm consumers and whether they deem it necessary to notify them.

White & Case partner Daren Orzechowski said that the House legislation would enable companies to have "a little bit of room to perhaps avoid a very big expense and some PR issues when in fact even though certain events happened, personal information was not actually put at risk."
